Christian Perrin recently authored an article entitled “Taming Paper Tigers: Addressing the Defense of Capacity in Power of Attorney Litigation” that was published in the Estate Planning Section of the North Carolina Bar’s June issue of its monthly publication, The Will & the Way. This article addresses the procedural and substantive requirements and considerations involved when proving a principal’s incapacity in response to a N.C.G.S. Section 32C-1-116(f) motion to dismiss an action for power of attorney abuse.
